These general terms and conditions of sale (hereinafter referred to as the "GTC") are concluded exclusively between the merchant https://www.the-hunting-shop.com/en/ or the Yvoir store belonging to the Laurent Duvivier company S.R.L. whose head office is located at 39, rue du Tricointe - 5530 Yvoir and registered with the Banque Carrefour des Entreprises under number 0459.964.892 (hereinafter referred to as "THS", "We" or "the parties") and any person visiting or making a purchase via the site https://www.the-hunting-shop.com/en/ or the Yvoir store (hereinafter referred to as "the customer", "the user", "you" or "the parties").
The parties agree that their relations will be governed exclusively by these GTC, which are available on the websitehttps://www.the-hunting-shop.com/en/.
These conditions may be subject to change from time to time, so it is necessary to reread them before each visit to the site https://www.the-hunting-shop.com/en/ (hereinafter referred to as the "Site"). These modifications are enforceable from the date they are posted online and cannot be applied to contracts concluded previously. Each purchase on the Site is governed by the GCS applicable at the date of the order. By validating your order, we consider that you have read and unreservedly accepted our terms and conditions. Finally, these GTC define the terms and conditions between THS and the User. They regulate the various steps to be followed to make a purchase on this site.

By accessing the Site or purchasing from the Yvoir store, you declare that you are 18 years of age and have the legal capacity to make a purchase and that you agree to abide by the Terms and Conditions of Sale.
We make every effort to describe and present the products sold on the site with the greatest care, by putting information on line relating to the essential characteristics of the products, in particular by means of technical descriptions from our suppliers and photographs illustrating the products. All images used to illustrate products are used solely to enhance their description and are in no way contractual. Furthermore, despite all our precautions, errors may have occurred, and we cannot be held liable for any such errors.
Some of our products are available over the counter, but are intended exclusively for use outside the European Union. This means that you are free to purchase and own this type of device or product, but that you are entirely responsible for its use. The mere fact of ordering this type of device or product on our site implies that you are fully aware of the conditions of import, transit, possession and use of these devices or products in the country of destination or transit.
Our products can be viewed and purchased by anyone with Internet access. We therefore ship products throughout the European Union and export products outside the European Union. Certain legislation concerning the purchase, sale, possession or use of our products is specific to each destination country. By validating your order, you declare that you are fully aware of the legislation specific to your country of purchase, transit, use or destination of the goods. You acknowledge that you are responsible for any direct or indirect consequences of your purchase.
The sale prices indicated on the Site are in euros and include all taxes applicable in Belgium, but exclude delivery costs. Any delivery charges are indicated to the User as he selects his products, and are invoiced at the end of the order in addition to the price of the products selected.
The User may choose to display the prices of products on the site in other currencies, but we decline all responsibility in the event of error or inaccuracy in the conversion system used, i.e. in the event of a difference between the total amount of your order in the chosen currency and the amount in euros.
We reserve the right to modify our prices at any time, but we undertake to apply the current prices indicated on the Site at the time of your order.
We inform you that in case of display of an erroneous price, obviously derisory (low price), whatever the reason (computer bug, manual error, technical error...), the order will be cancelled, even in case of initial validation.
The amount of each product and the total amount to be paid by the User for the purchase of the products will be recapitulated on a screen before final validation of the order and payment.
Please note that we will honour your order within the limits of our available stocks. However, it is understood that this availability is given as an indication, the products being able to be sold between the moment of the order by the User and the validation of this order.
In the event that one of the products ordered is not available in stock, we undertake to contact you by e-mail within 15 days of the date of your order in order to inform you of this fact and to let you know how soon this product could, if necessary, be delivered to you.
If some of the products you have ordered are temporarily unavailable, we will send you the available products and we will offer to send you the products missing from your order as soon as they become available again. If the availability time seems too long, or if we should no longer be able to track the product, we will reimburse you for the product in question.

The on-line provision of the credit card number and the final validation of the order by the User constitute proof of the completeness of the order. This validation constitutes signature and acceptance of all operations carried out on the Site by the User.
However, the order itself, by the User, does not constitute a sales contract and the products remain the property of THS as long as the price is not entirely and definitively paid (goods, expenses, transport...). Nevertheless, the risk in respect of the goods passes as soon as the goods leave our warehouses and are handed over to our carrier.
We reserve the right to refuse an order if there is a previous dispute in progress.
We accept :
- by Bancontact, normal credit cards, via the secure PayPal or Stripe websites
- by credit card (Visa, MasterCard, ...) via the secure PayPal or Stripe websites
- Pay in instalments with Alma
Payment by instalments/deferred payment is available via our partner Alma. Payment security is ensured by Alma and its service providers. All payments are protected by 3D Secure.

Fees
By paying in instalments with Alma, the customer pays only the following additional charges:
Alma is a telepayment manager and issues an electronic certificate that serves as proof of the amount and date of the transaction in accordance with the regulations
provisions of articles 1316 et seq. of the French Civil Code.
Cancellation
Any termination of the General Terms and Conditions between the Seller and the customer shall result in the termination of the General Terms and Conditions between Alma and the customer.
Please note that :
- no COD shipments.
- payments by private or company cheques are not accepted.
- no payment terms or deadlines will be granted unless THS explicitly states otherwise in writing.
- certain countries or destinations are subject to import duties, customs fees, application of local vat or other taxes and fees. It is the customer's responsibility to find out about any such additional charges before placing an order, as they are entirely at the customer's expense.
- for export sales outside C.E.E., vAT of 21% is due and payable by the customer at the time the order is placed; as soon as the customer has provided us with the official customs document proving that the goods have been exported and that customs duties have been paid in the country of destination, we will refund the amount of VAT to the customer. This original document must be provided to us within a maximum of 3 months from dispatch of the order.
- in accordance with the law, our delivered goods remain our property until full payment of the initial invoice as well as any costs incurred as a result of non-payment on time. This includes, for example, all collection costs such as formal notice, bailiff's fees, interest on arrears, court costs, etc.
Delivery is only possible if the delivery address is perfectly correct; the consequences of a failed delivery due to a partially incomplete or faulty address remain entirely at the customer's expense.
Products are sent to the delivery address indicated at the time of ordering (personal, business or other address). We do not deliver to P.O. boxes.
Packages are generally dispatched within 2 days after receipt of payment and are shipped via Colissimo with tracking and drop-off without signature. Whichever shipment choice you make, we'll provide you with a link to track your package online as soon as possible.
Shipping costs include packaging, handling and postage. They may include a fixed part and a variable part depending on the price or weight of your order. We advise you to combine your purchases into a single order. We cannot group two distinct orders placed separately, and shipping fees will apply to each of them. Your package will be dispatched at your own risk, but special care is taken to protect fragile objects.
Packages are oversized and protected.

When the article is indicated "In Stock" at the time of your order, the delay between the placing of the order and the date of first presentation of the carrier at the determined place is the sum of 2 elements:
1. dispatch time (generally 48 h maximum) = validation of your payment + preparation of your order + collection of the parcel(s) by the carrier
2. the delivery time of your parcel by the carrier of your choice. You will be informed of the start of this period as soon as you receive the "Send order" e-mail.
These times are indicated in working days and can be consulted on the carrier's website, the address of which can be found on our "Delivery" page. The delivery time may be shorter than the stated delivery time.
We make every effort to meet delivery deadlines, however we cannot be held responsible for the consequences of late delivery or loss of the package caused by a third party to the contract, or by you, or due to an unforeseeable and insurmountable cause constituting a case of force majeure.
If the customer is absent at the time of delivery, the carrier may deliver a second time free of charge (depending on the delivery service in the country of destination).
If the parcel cannot be delivered, it will be made available to the customer free of charge at the carrier's dispatching office for a period of 6 to 14 calendar days, depending on the destination country.
After this period, the parcel will be returned to us. We will then consider that the customer has exercised his right of retraction and we will proceed with the reimbursement according to the conditions set out in the point "right of withdrawal". Shipping costs will be charged to the customer and will not be reimbursed.
Goods are always transported at the consignee's risk, and it is the consignee's responsibility to make any reservations and take any action against the carrier, who is solely responsible. Our parcels are checked by our shipping department and are sent to you intact and in good condition.
Upon receipt of your order, we recommend that you check the conformity of the products delivered with your order and indicate, if necessary, on the delivery note and in the form of handwritten reservations accompanied by your signature, any anomaly concerning them. Without prejudice to applicable legal guarantees, we recommend that you send any reservations regarding product conformity defects existing at the date of delivery as soon as possible by post to I&L Duvivier S.P.R.L., customer Service, Rue du Tricointe, 39 - B-5530 Yvoir or by e-mail toinfo@the-hunting-shop.com. Products may only be returned in their original condition, i.e. with their packaging, accessories and instructions for use.
Our transport costs are calculated as accurately as possible, taking into account the weight, volume and destination of the goods.
In most cases, your contribution to shipping costs does not cover the full actual cost. It is possible that if the estimated cost of transport calculated by our website is below the actual acceptable cost, we may ask you to make up the difference. In this case, if you are not happy with the extra cost, you can always cancel your purchase.
In the event of non-receipt of a parcel within the time limit indicated, an investigation is carried out with the carrier and may take several days (up to 30 days). During this period, no refund or return can be made.
In accordance with the legal provisions in force, the private consumer has a cooling-off period of 14 days from receipt of the products ordered online.
This clause is not valid between companies, nor for orders placed directly with the Yvoir store, whether in person, by telephone or by e-mail.
If the private consumer wishes to exercise his/her right of withdrawal, he/she must inform us by e-mail, to which we will reply with a returns agreement. He/she should pack the item(s) concerned carefully, attach a printed copy of the return agreement received from us by e-mail and return them to us by parcel post to the following address: Laurent Duvivier S.R.L., customer Service, Rue du Tricointe, 39 - B-5530 Yvoir.
This right of return can only be accepted for products returned in a condition that allows them to be sold again (with their original packaging, accessories, instructions, etc.). Items returned incomplete, damaged or soiled by the customer will not be accepted. Returns will be considered as non-conforming and will not be reimbursed.
Once you have exercised your right of withdrawal, we undertake to reimburse you in cash for the full price of the items returned, with the exception of the initial shipping costs, within a maximum period of 30 days.
Shipping costs for the return of goods are at the customer's expense.
The right of cancellation cannot be exercised for audio and video recordings, computer software and consumables unsealed by the customer, nor for custom orders that have led to a modification of the product (arrows cut to size for the customer, for example).
Our products are guaranteed for normal use. None of our products is intended for professional or public use. The general use of all our products, whatever their design, material, use or purpose, requires the utmost caution and is the sole responsibility of their users. Some items may present undetectable defects, and despite the greatest care we take to detect them, it is imperative to regularly monitor their evolution. In the event of the slightest doubt concerning the assembly, use or maintenance of a product or item, it is the responsibility of the customer or user to make their request or query in writing to our customer service department, so that we can advise them on the steps to be taken before any further handling or use of the device or product.
In application of the legal guarantee of conformity, THS undertakes to deliver your order in accordance with the sales contract concluded, and is liable for any defects in conformity existing at the time of delivery.
To comply with the contract, the products must :
1) correspond to the description presented on the Site at the time of your order;
2) be suitable for the uses to which products of the same type are usually put or for any other special use sought by the Customer of which the latter would have informed THS prior to his order and which the latter would have formally accepted;
3) present the usual quality and services of a product of the same type that any consumer can reasonably expect, taking into account the nature of the product and the characteristics described on the Site.
In the event of a proven lack of conformity, the defective product will be rectified at no cost to the customer.
We remind you that this legal guarantee covers any lack of conformity that appears within 2 years of delivery of your order.
Whatever the problem with your item, we recommend that you enclose with the defective item the warranty card that was supplied to you on delivery.
We also remind you that the legal warranty may not apply or may apply only partially in certain cases, such as:
- repair of damage resulting from a cause external to the device (e.g. accident, shock, lightning, current fluctuation, oxidation, presence of sand, etc.);
- the customer's fault, for example, resulting from use or installation that does not comply with the manufacturer's specifications;
- use which could damage the unit;
- any lack of conformity of which the customer was aware at the time the order was placed;
Commercial warranties provided by product manufacturers (product failure) :
In addition to the legal warranties, certain products sold on the Site benefit from the "manufacturer" warranty, the extent and duration of which vary according to the product and brand.
Generally speaking, "manufacturer" warranties don't cover you:
- replacement of consumables (e.g. batteries);
- abnormal or improper use of the products;
- damage caused by a repairer not authorized by the manufacturer;
- damage resulting from a cause external to the device (e.g. accident, internal or external shock, lightning, current fluctuation, oxidation, presence of sand, etc.).
We therefore invite you to carefully consult the instructions for use supplied with our products, as well as the exact terms of any manufacturer's warranties that may apply.
In all cases, THS cannot be held responsible if the manufacturer refuses to apply its warranty for the above-mentioned reasons.
Where the manufacturer's warranty does not apply, repairs will be subject to an estimate drawn up by the manufacturer. Administrative charges may be billed by the manufacturer if you request the return of your product without the repairs proposed in the estimate. You may also choose to abandon your product at no extra charge.
You have 3 months to accept or refuse the quotation and pay any amounts due. After this period, the quotation will be deemed to have been refused and the equipment abandoned, without any claim for compensation.
No product may be sent to the customer more than twice in succession by our after-sales service. If these two shipments fail (parcel refused, delivery impossible, etc.), the product will be left at the customer's disposal for 3 months. After this period, the equipment will be considered abandoned and THS will be entitled to dispose of it and destroy it, without any compensation being due.

This feature is intended to be constructive. All comments on our products posted by site users are monitored and moderated. THS reserves the right to refuse or modify any comments that infringe legal or ethical requirements (abusive advertising, defamatory statements, insults, comments out of context, etc.).
The information you provide is essential for the processing and dispatch of orders, and for the preparation of invoices and warranty contracts. Failure to provide this information will result in the cancellation of your order. By registering on the Site, you agree to provide us with true and accurate information about yourself. The communication of false information is contrary to these GTC. THS is the sole owner of the information concerning you.
THS undertakes to comply with the Belgian law of December 8, 1992 on the protection of privacy with regard to the processing of personal data, as amended by the law of December 11, 1998. This law is available on the website :http://privacy.fgov.be.
In accordance with the law of December 8, 1992 on the protection of privacy, you have a permanent right of access and rectification of all data concerning you. You can modify this data at any time via your account on the site.
THS may send you promotional e-mails offering new products, clearance offers, exclusivities, bargains and more. However, you may opt out of receiving such e-mails at any time by clicking on the link provided in the footer of each e-mail we send you.
THS cannot be held responsible for failure to meet any of its contractual obligations due to an act of God or force majeure.
As the availability of products is given for information only and is therefore not contractual, THS cannot be held responsible for the unavailability of one or more products.
Under no circumstances may THS be held liable for loss of profit, commercial loss, loss of data or loss of earnings, or any other indirect damage or damage that could not have been foreseen at the time the User used the site or requested a reservation.
Finally, THS cannot be held responsible for any damage inherent in the use of the Internet (cuts, viruses, etc.).

Any partial or total reproduction of the content by any process whatsoever and on any medium whatsoever is subject to prior authorization from THS.
THS shall in no way be held responsible for the violation by a User of rights held by third parties and perpetrated as a result of the User's activities on the Site.
These General Terms and Conditions of Sale comprise all the clauses of which they are composed. The fact that THS does not avail itself at a given time of any of the clauses herein, shall not constitute a waiver to subsequently avail itself of these same clauses.
In the event of invalidity of one of these clauses, the other clauses remain valid.
These general terms and conditions of sale are governed by Belgian law. Any dispute relating to the conclusion, validity, interpretation or performance of the contract and which has not been settled amicably shall be submitted to the sole jurisdiction of the Courts of Namur (Belgium), notwithstanding multiple defendants and/or third-party claims, even for emergency proceedings or protective proceedings in summary proceedings or by petition.
